Clyde introduces bill opposing FCC's AI ad disclosure rules

Today, Congressman Andrew Clyde introduced a bill titled the Ending FCC Meddling in Our Elections Act. This legislation aims to prevent federal funds from being used to enforce the Federal Communications Commission’s (FCC) proposed rulemaking concerning artificial intelligence (AI) in campaign advertising. A similar bill was introduced in the Senate by Senator Mike Lee earlier this year.

The FCC's proposal, which passed with a 3-2 vote along party lines, seeks to require television and radio providers to disclose when an AI-created ad is aired. The decision has been criticized for being partisan, as it was supported only by Democrat-appointed Commissioners. Critics argue that the FCC lacks the authority to impose new regulations on political speech.

Congressman Clyde expressed his concerns about the FCC's actions: “The FCC’s last-ditch effort to regulate campaign advertising before the most important election in our nation’s history is undoubtedly rooted in partisan politics,” he stated. He further described it as "an abuse of regulatory authority" and emphasized the need to stop taxpayer money from funding what he sees as an inappropriate regulation of political speech.

The text of the Ending FCC Meddling in Our Elections Act is available for public review. The bill has garnered support from several original cosponsors, including Representatives Jim Baird, Harriet Hageman, Doug LaMalfa, and Claudia Tenney.
